Trader and Investor visas offer natives of countries that are party to the US Trade Treaty the opportunity to work, direct, and control a business they have established in the United States.

This is a temporary or non-immigrant visa and the Merchant or Investor may renew their visa for an extended period while the company is in operation.

Due to a recent change in the law, the spouses of a Merchant or Investor can obtain a work permit as long as the “principal beneficiary” retains his status. An E-2 visa requires an average investment of $100,000 to $150,000. An immigrant investor, and under the EB-5 (Green Card) investor category, must make an investment of at least US$500,000 in a new business, which should generate at least 10 new full-time jobs.

Another option for investors is category L-1 visa. However, it is only after a detailed analysis of the situation and the specific case that it will be possible to determine with certainty which Investor visa category the client fits into.

THE BRIDE VISA (VISA K1)

A bride visa allows a foreign bride with a US citizen to enter the United States, marry within 90 days, and then apply for a Green Card in the United States.

Please note that the bride may only apply for the Green Card based on a marriage to a native of the United States and with the support of a pre-granted fiancee visa.

Unmarried children under the age of 21 are also able to accompany the bride.

A bride visa requires the wedding to take place in the United States.

The bride has 6 months to travel to the United States and thus use her K1 visa.

The wedding must take place within 90 days of the bride's arrival in the United States and within that time the bride must apply for a Green Card through a process known as “adjustment of status”.


THE WIFE/WEDDING VISA (VISA K3)

The K3 option (Marriage/wife visa) allows a US citizen's wife to enter the United States and then apply for a Green Card in the United States, which is known as the “status adjustment” process, or even return to their country of origin and receive a Green Card at a later date with the local US consulate or embassy.

Generally those who wish to travel to the United States to study must obtain an F-1, M-1 or J-1 visa.

 

F Visas - Academic Studies:

For people who have been accepted into the program of study or conduct research at a school or university located in the United States.

This is the most common type of student visa and is used for people who want to take an academic course. The university or college usually issues an I-20 form through the SEVIS system, which allows the applicant to apply for their student visa at the US Embassy in their home country.

The applicant must also prove that he/she has sufficient funds to pay for the course and his/her life while studying.

 

M Visas - Vocational or Non-Academic Studies:

For people who have been accepted into a program of study or training at a non-academic institution in the United States. A classic example of an M-1 visa is students who attend an aeronautics school.

 

J Visas - Academic Studies as Visitor Exchange:

For individuals who have been accepted into a program through the support of an organization designated to participate in a visitor exchange program in the United States.

The “J” visa is for educational and cultural exchange programs.

Note that J-1 are the ones commonly used by interns and trainees.

 

B Visa - Additionally, if you do not qualify for any of the above visas, you may also use the B2 visa to study in the United States for a limited period of time and under limited circumstances.

There are several ways to obtain permission to work in the United States, the correct category will depend.

the nature of the job, the employer, and whether or not the worker wants to move permanently to

the United States.

 

Examples:

If you are being transferred to the United States by your foreign employer then the L-1 visa may be right for you.

If you are a professional worker then the H-1B visa category may be right for you.

If you are an investor, or are employed by an investor in your country then the E-2 or E-1 visa category may be suitable for you.

Work A - INTRA-COMPANY TRANSFERS (Visas L-1A, L-1B)

L-1 visas allow a foreign company to transfer its managers and administrators to run a subsidiary or affiliate company based in the United States. It can also be used to transfer managers and employees to manage a newly created subsidiary or affiliate company in the United States, although it is necessary to prove that the operation in the United States has been incorporated (Signed Business Lease Agreement, Incorporation and Company Creation Documents , etc.).

Significantly, the L-1 visa category is not restricted to operations of a certain scope, nor is it necessary for foreign and US entities to engage in the same type/line of business.

The main advantage of an L-1 is that under some circumstances the holder of an L-1 can, after a period of time, obtain a Green Card without needing to go through an exhaustive work certification process. In addition, the spouse of an L-1 visa holder can obtain a work permit during their stay in the United States.

L-1 visa can be obtained relatively quickly, often within a few months. However, to ensure approval of their application within 15 days, the applicant must choose to pay an additional sum of $2,000 as a premium for expedited processing of their application.

Often the E-2 or E-1 visa category is an alternative to the L-1 visa category. Deciding which visa to apply for will depend on an in-depth analysis of the specific case, which should be done by a lawyer with immigration experience.

 

Work B - WORK VISAS FOR PROFESSIONALS (H-1b)

The H-1B is a category of visa issued to “professional” workers. In general, the applicant for H-1B must have a university degree in course of at least 4 years, or work experience of 12 years (if they do not have a university degree, since each year of college can be replaced by 3 years of proven experience). The work must be performed within your area of training and/or experience.

Work D - Visas for Graduates and Interns (Visas J-1)
